The Answer is being filed to address certain protests and comments filed by some of the intervenors in this docket in response to PJM’s shortage pricing proposal submitted to the Commission on June 18, 2010.

On August 23, 2010, in Docket No. ER10-2323-000, PJM filed revisions to Section 3.2.3(b)(ii)(A), Operating Reserves of Schedule 1 of the Operating Agreement, as well as the parallel provisions of Attachment K - Appendix of the PJM Tariff. PJM seeks implementation of proposed revisions to the balancing Operating Reserves allocation criteria to apply the criteria only for intervals where a resource is producing megawatts and to establish that where a resource was running for less than four intervals in an hour, the credits for that resource will be identified as being the same category as identified for the Operating Reserves for the other discrete clock hours. PJM requests an effective date of October 25, 2010 for these revisions.

On August 18, 2010 in Docket No. ER10-2280-000, PJM submitted for filing revisions to Sections 1.10.1(b) and 5.5 of Schedule 1 of the Amended and Restated Operating Agreement of PJM Interconnection, L.L.C., as well as the parallel provisions of Attachment K - Appendix to the PJM Open Access Transmission Tariff, to eliminate market participants’ ability to improperly submit Up-To Congestion bids the sole purpose for which is to obtain an allocation of the marginal loss revenue surplus. Because the proposed revisions are intended serve as a temporary solution while PJM and its stakeholders conduct a stakeholder process to address the issue, PJM requested that the Commission grant expedited treatment for this filing, shorten the comment period to 15 days, and issue its order by no later than September 17, 2010, with an effective date for the proposed revisions of September 17, 2010.
